A new property rights case has just fallen on Yuga Labs, the company behind the Bored Ape Yacht Club (BAYC). She is accused of stealing the property rights to a design for the creation of the logotype for her non-fungible token (NFT) collection appendix Bored Ape Kennel Club.

This is a new case with blurred outlines for Yuga Labs, the company behind the Bored Ape Yacht Club (BAYC). The latter is accused of having used – without authorization – an image of a site to develop the Bored Ape Kennel Club logoas one Twitter user first remarked:

Moreover, as he points out here, Yuga Labs filed a trademark application for his logotype (including this design with the BAKC characters) in November 2021, while Easy Drawing Tutorial, owner of the drawing, had already shared the sketch on social networks a few months earlier.
In addition, as indicated in the general conditions of the Easy Drawing Tutorial site, it is strictly forbidden to ” copy, modify, transmit, reproduce or use the content of the site to create derivative works “.
What the site confirmed in response to Colombo’s tweet, indicating that indeed, Yuga Labs did not hold a license for the drawingand that the right of ownership over the latter remained protected under the terms and conditions of the site.

The Yuga Labs explanation
Greg Solano, long known under the pseudonym “Garga”, published a press release on his Twitter account to express his incomprehension. In particular, it indicates that Yuga Labs has already contacted the freelance artist hired at the time the development of the logotype for the Bored Ape Kennel Club:
Saw the claims today about the BAKC logo. This was news to us and we’re still investigating the situation. Have reached out to the freelancer we hired for that design and Easy Drawing Guides. We’ll be changing the logo and updating it on our site / ask marketplaces to change as… https://t.co/OwtflDXehz

Thus, according to Garga, the logotype should be reworked soon and the platforms offering the NFTs concerned will also have to update it. He defends himself by adding thatfrom the beginning », the collection concerned had been created in order to raise funds for animal protection associations, cause for which Yuga Labs actually paid over a million dollars.
However, as their own site indicates, only the royalties collected during the first six weeks of sales have been used for this purpose. The rest of the time, Yuga Labs collected 2.5% of transaction fees collected on secondary markets such as the OpenSea platform.
Bored Ape Kennel Club NFTs were originally given to Bored Ape owners as a reward, much like mutant serums. However, the collection still sits in the Top 10 collections on Ethereumalongside other Yuga Labs collections like Otherdeed.
Otherdeed’s plots are the most lucrative sideline collection for Yuga Labs, the company having raised several hundred million dollars thanks to them.
